Terms and Conditions of Use

By using, creating an account with or placing an order at HLJ.com (the “website” or “service”), you agree to the following terms and conditions of use for our website (the “Terms and Conditions”). Please read these Terms and Conditions carefully before using our website. These Terms and Conditions form an agreement between you and HobbyLink Japan Ltd. (“HLJ”, “we”, “us” or “our”) that applies to your use of the website, including purchasing products from HLJ through the website. 

Your access to and use of the website is also conditioned on your acceptance of and compliance with HLJ’s privacy policy set forth here. Our privacy policy describes our policies and procedures on the collection, use and disclosure of your personal information when you use the website and tells you about your privacy rights and how the law protects you. Please read our privacy policy carefully before using our website.

1. Account & Order Ownership

By creating an account on HLJ.com, you are responsible for

  • Maintaining the confidentiality of your HLJ account and password
  • Restricting access to your HLJ account
  • All activities that occur under your HLJ account and password
  • Canceling any open (unbilled) orders that you no longer wish to purchase

Customer accounts and orders on HLJ.com are the sole property of the registered account holder, and are not to be sold, loaned, or otherwise transferred to another party or HLJ account. To do so will be grounds for the cancellation of all orders, and the closure or termination of their HLJ account (and any related HLJ accounts) without notice.

HLJ accounts are intended to be one per person. Customers may not hold accounts at both https://hlj.com and https://hlj.co.jp at the same time. At our discretion, HLJ customer accounts may be limited to one per household.

We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders for any reason without notice. Without limiting the foregoing, we may terminate your account and cancel orders if you do not respond to our email inquiries within ninety (90) days from your receipt of such email inquiries.

If you wish to terminate your account, you may do so by contacting support@hlj.com.

When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of these Terms and Conditions, which may result in immediate termination of your account on our service.

All account owners must be 18 years of age or older.

2. Payment

The yen price at the time you place an order is the price you will be charged. HLJ reserves the right to revise its prices at any time prior to the time you submit your order. Due to international exchange rate fluctuations, prices in your preferred currency may change from the time you submit an order to the time you are actually charged for it. The yen price does not change.

If you pay by PayPal Billing Agreement in a limited currency, PayPal will handle the exchange to Japanese yen. There may be a fee for this through PayPal or your credit card company. (Please see this chart to see if your preferred currency is limited.) Please consult with PayPal or your credit card company for details.

If you pay by PayPal Billing Agreement in Japanese yen, PayPal will process the transaction. There may be a fee for this through PayPal or your credit card company. Please consult with PayPal or your credit card company for details.

If you pay by PayPal Billing Agreement in an available currency (see this chart), by credit card, or by another payment method via Reach, you will pay directly in your selected currency. Reach does not charge customers any additional fees for payments processed via their service. However, it’s possible that your bank or credit card provider could still charge a fee based on your currency selection on our website, and your payment method’s currency. Please consult with your credit card company for details. 

On rare occasions, at our discretion we may require prepayment for a high-value preorder item. If this is the case, we will contact you in advance.

3. Authorization to Charge the Customer

The act of placing an order through our website constitutes your permission to us to bill and ship (or bill and hold in your Private Warehouse) the items you order. We do not require any additional approval to charge your registered payment method prior to shipping or warehousing, even if the final amount to be charged, including shipping costs, has not been confirmed with you. We will charge or bill you immediately for all in-stock items, which will then either be shipped or warehoused based on your order handling method.

If seven days pass from the time we first attempted to charge you, with no payment and no contact from you, that order will be canceled. Your HLJ account, and any related HLJ accounts, will also be disabled until you contact us again. If you are having a temporary payment problem, please contact us as quickly as possible to prevent these penalties.

4. Store Credit

HobbyLink Japan store credit is valued in Japanese yen, and is for exclusive use with orders at https://www.hlj.com. Provided, however, we reserve the right to change our store credit system in the future, including to a system where store credit is maintained or valued in the form of “points” instead of being maintained or valued in yen.

Store credit automatically applies to your next payable transaction(s) with us. We are not able to apply store credit to a particular order or item that is not the next paid transaction. Unused store credit expires 5 years from distribution date and cannot be exchanged for a cash refund. Store credit cannot be transferred from one HLJ account to another. Your store credit history and balance can be seen in the My Account system (accessible by clicking "My Account" on the top right of pages on https://www.hlj.com).

Bonus store credit may also occasionally be offered as an incentive in special marketing campaigns. This credit will be distributed as per the terms of each individual campaign.

5. Shipping Policies

Ship Now

When an item is in-stock at the time of an order, “Ship Now” can be selected. Customers who select “Ship Now” will be charged for such in-stock items and applicable shipping fees after checkout completion, and after payment confirmation, such in-stock items will then be shipped out using the customer’s selected shipping method.

 

Private Warehouse

A Private Warehouse is a “virtual” storage site that can store items purchased by customers for up to sixty (60) days (the “Warehouse Period”). The Warehouse Period may be adjusted by the Company in its sole discretion.                  

Private Warehouse for In-Stock Items: Instead of selecting “Ship Now” at the time of purchasing in-stock items, customers may select to have such in-stock items be stored in the Private Warehouse.

Private Warehouse for Pre-Ordered, Out-Of-Stock Items: Pre-ordered, out-of-stock items shall be charged to customers once such items become available in-stock. Upon payment confirmation, such items shall be stored in the Private Warehouse. 

When customers are ready to ship items stored in the Private Warehouse, customers may request shipment of such items from their account page. Customers will be charged shipping costs after completing the shipping request process. Upon confirmation of payment of shipping costs, such selected items will be shipped out from the Private Warehouse using the customer’s selected shipping method.

If a Private Warehouse item is not shipped before the expiration of the Warehouse Period, then, at any time after the expiration of the Warehouse Period, HLJ may, at its option, (i) automatically ship such item to you or (ii) return such item to stock and issue a store credit to you subject to a 15% restocking fee.

If a Private Warehouse item enters automatic shipping upon the expiration of the Warehouse Period and payment of shipping costs is not received from you, then HLJ may, at its option, cancel and return such item to stock, and the customer will receive 85% of its cost as store credit.

There is no storage fee for storing items in the Private Warehouse.

Overall

When your order handling method is Ship Now we will process your order for shipping and charge you immediately for the merchandise and shipping costs for in-stock, on-site items. We will attempt to combine separate Ship Now orders if they are placed within a few hours of each other, or if they were ordered at different times but happen to come into stock at the same time. Ship Now orders will not be combined if placed with different shipping methods.

If you absolutely do not want your orders to be combined, please select Private Warehouse, so that you can control the contents of shipments yourself.

When your order handling method is Private Warehouse, we will charge you for the shipping costs when you request a shipment, or when an item enters automatic shipping.

If the size of an item in your order prevents the use of your selected shipping method, we will ship your order by another method, depending on where you live, at our sole discretion. 

There may be limits to the size of packages that can be shipped. These limits may be set by your country's post office, or it may be physically impossible to ship many large items in one box. In such cases, your order may have to be shipped in more than one box. We reserve the right to ship your order in multiple packages if necessary.

All additional costs related to changes in your shipping method for any of the reasons above will be charged to you.

A package’s delivery is complete when the package is delivered to the shipping address you provided for it in your HLJ account. HobbyLink Japan is not responsible for anything that may happen to a package or its contents after it was delivered to the shipping address you provided. Any use of third-parties or reshippers is at the risk of the customer.

6. Product Availability

Items placed in the Shopping Cart are not held for you. An order is not placed until you complete the checkout process. Items may be removed from the Shopping Cart as stock status changes.

After you place an order, backordered items will remain on order until you cancel them yourself, or we become convinced that an item will not be available for the foreseeable future and cancel it ourselves. You will be informed in an email from us if this happens.

Stock statuses advertised on third-party websites do not necessarily reflect the current stock status of an item. When conflicting stock statuses are shown between third-party websites and HLJ.com, the HLJ.com stock status takes precedence.

The order of any pre-order items does not constitute a guarantee of that item becoming available for you but indicates your intention to purchase the item if we are able to procure it. We do not offer any guarantee or promise that your order will be filled and can only guarantee your product once stock has arrived that has been allocated to you. Once such pre-ordered item arrives in-stock, then HLJ will charge you for such item and store it in the private warehouse.

7. Returns

Requests for returns, for any reason, must be received within 10 days of delivery to be considered. 

  • Returns of Unwanted Items

Merchandise must be unopened with all parts and components present, packed exactly as packed by the manufacturer, and without damage to the outer package. Opened "blister pack," "blister card," or sealed "blind box" merchandise that cannot be opened without cutting or tearing the package or its seal cannot be returned. Pre-owned items and the contents of Lucky Bags also cannot be returned.

If the above conditions are met, we will authorize the return and will refund you in full for the merchandise costs when we receive the returned items. However, we cannot refund the original shipping cost or any return shipping costs.

  • Returns of Damaged or Defective Items

Damaged or defective items must be returned to us as directed by our customer support team to be refunded as an authorized return. If these conditions are met, we will refund you in full for the merchandise costs, the original shipping cost, and any return shipping costs.

Damage to product packaging or boxes are not considered product damage. We are only able to consider returns in cases of damage or defects of the actual merchandise itself.

We reserve the right to reject claims of manufacturing defects on items in cases of obvious user abuse.

  • Packages Returned by the Post Office or Courier

A package returned to us by the post office as undeliverable or unclaimed, or a package refused by the addressee for any reason, is not an authorized return. As such, it may not be eligible for a refund of the cost of merchandise, at our discretion.

The cost of shipping will never be compensated in the case of a package returned to us by the post office as undeliverable or unclaimed, or a package refused by the addressee for any reason.

If your package has incurred freight charges for its return to us, you are responsible for reimbursing us for those charges.

Returned international packages cannot be reshipped within Japan, and returned domestic packages cannot be reshipped internationally.

8. Refunds

For cash refunds payable to you pursuant to Section 7 above, if such refund is payable (a) within 60 days of the date payment was received by HLJ, we will provide refunds in the currency and payment source originally used to complete the transaction or, if the customer prefers, as store credit in yen, at the current day’s exchange rate (accepting a refund as store credit would avoid any fluctuations in exchange rates) or (b) after 60 days of the date payment was received by HLJ, we will refund in yen by the customer’s choice of PayPal or store credit, at the current day’s exchange rate. 

For the reimbursement of a payment made to an entity other than HLJ (such as for return shipping costs), we will reimburse in yen by the customer’s choice of PayPal or store credit, at the current day’s exchange rate.

Store credit may be issued as a refund for a returned or defective item, or for a Private Warehouse item that is returned to stock, or in lieu of a cash refund if a cash refund to your original payment source has been unclaimed, refused, or unable to be sent.

HLJ does not cover any fees charged by your credit card company or PayPal when processing refunds. All such fees are the sole responsibility of the customer.

HobbyLink Japan is not able to provide any form of monetary compensation for orders that are canceled without payment for any reason -- including but not limited to manufacturer cancellations, shortage of stock, or delays in release dates.

9. Cancellations

  • Preorder & Open Order Cancellations

While we accept customers' cancellations of all or part of their order at any time prior to billing, we ask that you keep cancellations to a minimum.  Overstocks due to customer cancellations affect our ability to offer great prices, so this is in everybody's best interest.

Cancellations are permanent, and canceled items or orders cannot be reinstated. Customers will need to place a new order for canceled items they still wish to purchase. If canceled items are no longer available, HobbyLink Japan is unable to make them available again under any circumstance.

We reserve the right to limit or close the accounts of customers who abuse the cancellation policy, or abandon shippable orders without submitting payment.

Once a paid order enters shipping processing, it cannot be canceled, but can be returned as described in our Returns section above.

  • Private Warehouse Cancellations

Private Warehouse items can be returned as long as they have not entered shipping processing.

Returns requested within 10 days of the date the item entered payment processing are eligible for a 100% refund. Such refunds may be returned to the original payment source, or as HLJ store credit, at the preference of the customer.

Returns requested after more than 10 days have passed since the date the item entered payment processing are subject to a 15% restocking fee. Such refunds can only be provided as HLJ store credit.

  • Prepayment

In certain situations, at our discretion, we may require prepayment for a high-value preorder item.  In general, HLJ does not accept cancellation of such prepaid items. Please contact customer support in case of any extenuating circumstances that would warrant the cancellation of such prepaid item and HLJ shall consider your situation at its discretion.

10. Per-Customer Limits

If an item has a per-customer limit, that limit will be stated on the item's page or in the shopping cart. We ask that you respect these limits.

A per-customer order limit of one per customer means you can only order a total of one. If you already ordered one, and the item becomes available for sale again with a per-customer limit of one, please do not order it again; you have already ordered the limit.

If an item has a per-customer limit, the limit will be enforced. Any customer attempting to manipulate our system to place orders so that the total quantity is beyond the stated limit may have their orders canceled and their account (as well as any related accounts) locked or terminated without notice.

In the event that we receive less stock than was ordered, at the discretion of our order department, a per-customer limit may be applied to existing orders or lowered further to help as many customers as possible acquire the item.

11. Payment Disputes & Chargebacks

HobbyLink Japan is committed to customer service and will promptly address any customer claims as detailed in these Terms and Conditions. Because we're committed to helping you, under no circumstances should you ever contact your credit card company or PayPal to dispute charges from HobbyLink Japan.

We will make reasonable efforts to solve all genuine customer service problems through refunds, reshipments, discounts or whatever else it takes to reach a fair solution to the problem, and that's our promise! But we will need to hear from you if a problem has occurred.

HobbyLink Japan vigorously contests any PayPal or credit card disputes or chargebacks filed by customers. Customers who have filed such disputes or chargebacks may be prohibited from using our service, meaning we will accept no further orders from them.

12. System Manipulation

Any user found to be manipulating or attempting to manipulate any system feature or process, through any means of their own, third-party software, or any other method, may have their orders canceled and their HLJ account (as well as any related HLJ accounts) locked or terminated without notice, at our sole discretion.

13. Product Descriptions

We always try to be as accurate as possible on our website. However, we do not warrant that product descriptions or other content of this website are accurate, complete, current, or error-free.

If a product offered by us is not as described, please contact us as soon as possible. If you have any questions about the nature of an item that are not addressed on our website, you are responsible for asking us before you purchase the item. If you have not asked us before purchasing and the item is not what you expected, the only solution is an authorized return as described above.

We reserve the right to change or update information (including product descriptions) and to correct errors, inaccuracies, or omissions at any time without prior notice.

14. Sales & Promotions

If a promotion or sales campaign on HLJ.com has rules that differ from these Terms and Conditions, such promotion or sales campaign’s rules will take precedence. If you participate in any such promotion or sales campaign, please review the applicable rules as well as our privacy policy.

15. Reach Payment Processing Provider

HobbyLink Japan offers payment processing through Reach, a trusted service provider that allows you to pay in your local currency by a variety of payment methods, including several credit cards and PayPal.

In addition to the convenience and comfort of paying in your preferred currency, in an array of new payment methods, we believe Reach's processing to be more economical for our customers than any of our previous payment processors.

Customers will see prices displayed on HLJ.com in both their preferred currency and yen. Prices in HLJ order e-mails are displayed in yen, but you will be charged in your preferred currency by the payment method you selected, at the exchange rate utilized by the payment provider at the day/time the transaction is completed. Your credit card statement or PayPal statement will show the name “Reach,” “RCH,” "CKO WithReach," “Calforex,” "GoInterpay," "GIP," or some combination of these descriptors as the recipient, instead of HobbyLink Japan.

REACH SHOPPER-FACING TERMS

(a)  Payment Processing: HobbyLink Japan ("Supplier") provides international payment processing and order fulfillment through its designated service provider, Calgary Foreign Exchange Ltd. (doing business as Reach) ("Reach") as the Merchant-of-Record. When placing an order through Supplier, your order will be processed using Reach checkout and payment processing services, and you acknowledge and agree that: (a) your payment transaction will be processed via Reach, not Supplier, and (b) upon successful verification and authentication by Reach of payment information provided by you, Reach will accept the transaction, and purchase the products from Supplier for the sole purpose of reselling such products to you at a price equal to the amounts presented to and agreed-upon by you. Reach will provide the merchant or Supplier with its own payment information to purchase the products you have ordered, and Reach will resell such products to you and bill the payment information you have provided. Reach acquires flash title to the products when the products exit the jurisdiction of Supplier. After Reach purchases and takes title to products from the Supplier to fulfill an order you have placed, you take title from Reach before the products enter the jurisdiction that you have designated as your address for delivery. All items purchased from Reach are made pursuant to a shipment contract. In the event of any disparity or inconsistency between the terms of any shipment contract or order fulfilment terms, the terms of this agreement shall prevail to the extent required to resolve the disparity or inconsistency.

(b)  Billing. If you provide a credit card as your tender type, your credit card will be billed by Reach, and charges to your account will be accompanied by the descriptor “Reach” (or such other descriptor as Reach may deploy), which denotes the Reach system, and that Reach is the supplier whose products you have purchased through Reach. If you paid using your PayPal account, charges to your account will be accompanied by the descriptor “MERCHANT VIA REACH” (or such other descriptor as Reach may deploy). In either case, you will only be billed by Reach after your products have been received and processed. In the event of the receipt of any parcel from Supplier containing only part of an order, Reach will process the products received, and will only bill for an amount commensurate with the price of the products therein, pro-rated amounts for shipping. Notwithstanding the foregoing, in the event of an order being fulfilled by Supplier in multiple parcels, unless expressly consented to by you, in no instance will the aggregate amount billed to you by Reach exceed the total amount presented at the time of order placement by you. If there is a technical error in the Reach system which processes or accepts a transaction at an exchange rate which is manifestly off-market, that transaction shall be void.

16. Changes to These Terms and Conditions

We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions at any time. By continuing to access or use our website and/or service after these Terms and Conditions have been revised, you agree to be bound by the revised Terms and Conditions. If you do not agree to the new terms and conditions, in whole or in part, please stop using the website and/or terminate your account.

17. Intellectual Property and Third Party Websites

The service is protected by copyright, trademark, and other laws of both Japan and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

 

Our service may contain links to third party websites or services that are not owned or controlled by us.

We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third party websites or services. You further acknowledge and agree that HLJ shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such third party websites or services.

18. Limitation of Liability

Notwithstanding any damages that you might incur, the entire liability of HLJ and any of its suppliers under any provision of these Terms and Conditions, including your use of the website and purchase of products through the website, and your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by you through the service for the product giving rise to such liability or One Hundred US Dollars ($100.00 USD) if you have not purchased anything through the service.

 

To the maximum extent permitted by applicable law, in no event shall HLJ or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including damages for loss of profits, loss of data or other information, for business interruption, for personal injury or otherwise in connection with any provision of these Terms and Conditions), even if HLJ or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

 

Some states do not allow the limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply. In these states, each party's liability will be limited to the greatest extent permitted by law.

 

Some jurisdictions do not allow limitations on applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to you. But in such a case the exclusions and limitations set forth in this section shall be applied to the greatest extent enforceable under applicable law.

19. Governing Law, Exclusive Dispute Jurisdiction and Severability

The laws of Japan, excluding its conflicts of law rules, shall govern these Terms and Conditions. Your use of the service may also be subject to other local, state, national, or international laws. If you have any concern or dispute about the service, you agree to first try to resolve the dispute informally by contacting HLJ. By accessing and using the website, you submit and consent to the exclusive jurisdiction of the courts located in Tokyo, Japan with respect to any dispute or cause of action arising out of or in connection with these Terms and Conditions, the Privacy Policy or any products purchased using the website.  

 

If any provision of these Terms and Conditions is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

 

For European Union (EU) Users: if you are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident in.
